These Terms and Conditions (“Terms”) apply to your use of the National EUO, LLC (“National EUO,” “we,” “us,” or “our”) website, our examination under oath (EUO) services, and all of our events, seminars and training programs, whether held in person or online. “You” means the person using our website, purchasing our services, or registering for or attending a program (an “Attendee”).
By using our website, registering for or attending a program, purchasing a product, or assigning an EUO file, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our website or register for our programs.
National EUO provides EUO services to insurers, law firms and claims professionals. The scope, schedule and fees for any EUO assignment are set by the engagement terms agreed for that assignment. If separate written engagement terms conflict with these Terms, the engagement terms control for that assignment.
We offer training programs, including the Complete EUO Business course and other EUO and statement training programs, for lawyers, law firms, law students, insurance companies, claims professionals and others. Program content, format and schedules may change, and new programs may be added.
The Complete EUO Business course is a prerequisite for our other programs unless we tell you otherwise in writing.
These Terms apply to in-person events (whether at a hotel, our facility or a site you designate) and to online and live-streamed sessions.
Our website, programs and materials are for educational and informational purposes only. They are not legal, financial, tax, medical, psychological or other professional advice, and they do not create an attorney-client relationship with National EUO or Daniel Vazquez, Esq. You are responsible for complying with the rules of professional conduct and other laws that apply to you, and you should consult your own advisors before making business, legal or financial decisions.
We do not believe in “get rich quick” or “quick-fix” programs. Building a professional EUO practice or business takes hard work, discipline and a commitment to serving clients well, just like any worthwhile professional endeavor.
We cannot and do not make any guarantee about your ability to get results or earn any money with our ideas, information, tools or strategies. Nothing on our website, in our content or in our curriculum is a promise or guarantee of results or future earnings. Any financial figures we reference are illustrations of concepts only; they are not average earnings, exact earnings or promises of actual or future performance.
Any business decision carries risk, including the risk of loss. Use caution and consult your accountant, lawyer or other professional advisor before acting on any information. You alone are responsible for your decisions, actions and results.
30-day 100% satisfaction guarantee. As stated on our current website, we offer a 30-day, 100% satisfaction guarantee on the EO Complete Business program: if you are not happy with the quality of our training for any reason, contact us within 30 days of the date of purchase and ask for your money back.
The guarantee does not apply to Attendees removed for conduct under Section 4.
When you register for a program or event, we make arrangements and commitments based on your attendance. Please register only if you are committed to attending.
All program content, including videos, slides, workbooks, templates, forms, processes and strategies, is owned by National EUO or its licensors and is protected by copyright and other laws. Your purchase gives you a personal, non-transferable license to use the materials for your own professional education and practice.
You may not record, copy, distribute, resell, publish, summarize for distribution, or teach or train others from our materials without our written permission. Unauthorized use may result in loss of access without refund, and we may pursue all available legal remedies, including damages and injunctive relief.
No recording by attendees. Attendees may not record audio or video, or take photographs, during sessions unless we approve it in advance.
Event photos and recordings. At live and group training events, we may photograph or record sessions. Attendees may appear in these photos or recordings.
Consent. We will use an Attendee’s name, image, voice or testimonial in marketing or advertising only with that Attendee’s consent. You may decline, or later withdraw consent for future uses, by contacting us.
Confidential matters are never used. Recordings of actual EUOs, client matters, or any confidential client information are never used in our marketing or advertising.
We want our programs to be accessible to everyone. If you need an accommodation to participate, such as a sign language interpreter, captioning, or alternative materials, please contact us as early as possible, ideally at least 30 days before a live event, so we can make arrangements.
We will work with you in good faith to provide a reasonable accommodation. If a program component cannot reasonably be made accessible to you, we will discuss alternatives with you, which may include different learning formats or a refund.
Attending an in-person event involves ordinary risks such as travel and use of a venue. You attend voluntarily and are responsible for your own safety, belongings and conduct. To the fullest extent permitted by law, you release National EUO, Daniel Vazquez, and their officers, employees, contractors, sponsors and representatives from claims for injury, illness or property loss arising from your attendance, except to the extent caused by their gross negligence or willful misconduct.
You agree to be responsible for, and to indemnify us against, claims arising from your own negligent or intentional acts while attending. If you need emergency medical care during an event, you consent to that care and are responsible for its cost. Please tell us in advance about any medical condition or need that may affect your participation.
To the fullest extent permitted by law, National EUO, Daniel Vazquez, and their affiliates, speakers, sponsors and contractors will not be liable for any indirect, incidental, consequential, special or exemplary damages, including lost profits or business losses, arising from your use of our website, programs, materials or services, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim relating to a program or service will not exceed the amount you paid us for that program or service.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
If a dispute arises out of or relates to these Terms, our website, services or programs, the parties will first try to resolve it through non-binding mediation in the State of Florida with a professional mediator. If mediation does not resolve the dispute, it will be resolved by binding arbitration in the State of Florida administered by the American Arbitration Association (AAA) under its applicable rules.
If any provision of these Terms is found unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will stay in full force and effect.
We may update these Terms from time to time. Changes take effect when posted, and the “Last updated” date above will show when they were last revised. Changes will not affect registrations or purchases completed before the change unless required by law.
